RAQAMLASHTIRISH SHAROITIDA XALQARO MEHNAT STANDARTLARINING TRANSFORMATSIYASI

Mazkur maqolada raqamli iqtisodiyot, platforma mehnati va sunʻiy intellekt texnologiyalarining keng joriy etilishi sharoitida XX asr oʻrtalarida shakllangan klassik xalqaro mehnat standartlari tizimining transformatsiya jarayoni xalqaro-huquqiy jihatdan tahlil qilinadi. Xalqaro Mehnat Tashkiloti (XMT) tomonidan ishlab chiqilgan asosiy mehnat sohasiga oid normalar – mehnatda asosiy huquq va tamoyillar, ish vaqti, mehnat muhofazasi, ijtimoiy himoya va birlashish erkinligiga oid konvensiyalar – raqamli mehnat shakllari (gig-iqtisodiyot, masofaviy ish, algoritmik boshqaruv) bilan qanchalik mos kelishi hamda yuzaga kelayotgan normativ boʻshliqlar masalasi oʻrganildi. Tadqiqotda XMTning 2019-yilgi “Mehnat sohasining kelajagi toʻgʻrisida”gi yuz yillik deklaratsiyasi, 2022-yilda xavfsiz va sogʻlom mehnat sharoitining asosiy tamoyilga aylantirilishi, shuningdek platforma ishchilarining huquqiy maqomiga oid xalqaro va milliy amaliyot qiyosiy tahlil etildi. Tahlil natijasida raqamlashtirish sharoitida “ishchi” va “ish beruvchi” tushunchalarining transformatsiyasi, algoritmik shaffoflik, maʻlumotlar himoyasi va transchegaraviy mehnat munosabatlarini tartibga solishga oid takliflar ishlab chiqildi. Oʻzbekiston Respublikasi qonunchiligini xalqaro standartlarga muvofiqlashtirish, jumladan platforma mehnati, masofaviy ish va raqamli mehnat huquqlarini himoya qilish boʻyicha aniq tavsiyalar berildi.
